USING CHILD FOR PORNOGRAPHIC PURPOSES AND PUNISHMENT THEREFOR
Section 13 to 15
Section 15 - Punishment for storage of pornographic material involving child.
(1) Any person, who stores or possesses pornographic material in any form involving a child, but fails to delete or destroy or report the same to the designated authority, as may be prescribed, with an intention to share or transmit child pornography, shall be liable to fine not less than five thousand rupees, and in the event of second or subsequent offence, with fine which shall not be less than ten thousand rupees.
(2) Any person, who stores or possesses pornographic material in any form involving a child for transmitting or propagating or displaying or distributing in any manner at any time except for the purpose of reporting, as may be prescribed, or for use as evidence in court, shall be punished with imprisonment of either description which may extend to three years, or with fine, or with both.
(3) Any person, who stores or possesses pornographic material in any form involving a child for commercial purpose shall be punished on the first conviction with imprisonment of either description which shall not be less than three years which may extend to five years, or with fine, or with both, and in the event of second or subsequent conviction, with imprisonment of either description which shall not be less than five years which may extend to seven years and shall also be liable to fine.]

S15- बालकों को सम्मिलित करने वाली अश्लील सामग्री के भंडारकरण के लिए दंड.
(1) कोई भी व्यक्ति, जो बालक संबंधी अश्लील साहित्य को साझा या पारेषित करने के आशय से किसी बालक को सम्मिलित. करने वाली अश्लील सामग्री का किसी भी रूप में भंडारकरण करता है या रखता है, किन्तु उसे मिटाने या नष्ट करने या ऐसे अभिहित प्राधिकारी को, जो विहित किया जाए, रिपोर्ट करने में असफल होता है, वह पांच हजार रुपए से अन्यून के जुर्माने से और दूसरे या पश्चात्वर्ती अपराध की दशा में ऐसे जुमनि से, जो दस हजार रुपए से कम का नहीं होगा, दायी होगा ।
(2) कोई भी व्यक्ति, जो किसी बालक को सम्मिलित करने वाली अश्लील सामग्री का रिपोर्टिंग के ऐसे प्रयोजन के सिवाय, जो विहित किया जाए, किसी भी समय, किसी भी रीति में पारेषण या प्रदर्शन या प्रचार या वितरण करता है या न्यायालय में उसका साक्ष्य के रूप में उपयोग करता है, वह किसी भी भांति के कारवास से, जो तीन वर्ष तक का हो सकेगा, या जुमनि से या दोनों से दंडित किया जाएगा ।
(3) कोई भी व्यक्ति, जो किसी बालक को सम्मिलित करने वाली अश्लील सामग्री का किसी भी रूप में वाणिज्यिक प्रयोजन के लिए भंडारकरण करता है या रखता है, वह पहली दोषसिद्धि पर किसी भी भांति के कारावास से, जो तीन वर्ष से कम नहीं होगा, किन्तु जो पाँच वर्ष तक का हो सकेगा या जुमनि से या दोनों से दंडित किया जाएगा और दूसरी और पश्चात्वर्ती दोषसिद्धि की दशा में किसी भी भांति के कारावास से जो पांच वर्ष से कम नहीं होगा, किन्तु जो सात वर्ष तक का हो सकेगा, से दंडित किया जाएगा और जुर्माने का भी दायी होगा ।

1. जो कोई भी व्यक्ति किसी बच्चे को अश्लील साहित्य मे सम्मिलित करने के लिए किसी भी तरह की अश्लील सामग्री को अपने पास संभाल कर रखता है , या उसे मिटाने और नष्ट करने में सफल होता है और साथ ही किसी भी अधिकारी को इस तरह के अपराध के जानकारी देने में असफल होता है और इस तरह के अश्लील सामग्री को वह किसी को intentionally share or transmit करता है तब उस व्यक्ति को 5000 जमाने से दंडित किया जाएगा और इस तरह का अपराध दोबारा दोहराने पर उसे ₹10,000 का जुर्माना लगाया जाएगा |
2. जो कोई व्यक्ति किसी बच्चे को pornography में involve करने के लिए किसी भी तरह की अश्लील सामग्री को किसी और व्यक्ति के पास या कहीं भी display और distribute करता है तो उसे punish किया जाएगा 3 year imprisonment or with fine or with both .
* Exception - ऐसा वीडियो या ऐसा कोई भी सामग्री जो जो किसी अथॉरिटी या कोर्ट के पास as a evidence or proof के लिए रखा जा रहा है तो यह अपराध नहीं माना जाएगा |
3. ऐसा व्यक्ति जो child pornography Mater को commercial purpose के लिए use करता है तो उसे punish किया जाएगा - min 3 year - max 5 year imprisonment, with fine or with both.
और यही अपराध दोबारा दोहराने पर punishment होगी - min 5 year - 7 year imprisonment, or with fine or with both.
