USING CHILD FOR PORNOGRAPHIC PURPOSES AND PUNISHMENT THEREFOR

Section 14 - Punishment for using child for pornographic purposes.-
(1) Whoever uses a child or children for pornographic purposes shall be punished with imprisonment for a term which shall not be less than five years and shall also be liable to fine, and in the event of second or subsequent conviction with imprisonment for a term which shall not be less than seven years and also be liable to fine.
(2) Whoever using a child or children for pornographic purposes under sub-section (1), commits an offence referred to in section 3 or section 5 or section 7 or section 9 by directly participating in such pornographic acts, shall be punished for the said offences also under section 4, section 6, section 8 and section 10, respectively, in addition to the punishment provided in sub-section (1).

अश्लील प्रयोजनों के लिए बालक के उपयोग के लिए दंड. - (1) जो कोई अश्लील प्रयोजनों के लिए किसी बालक या बालकों का उपयोग करेगा, वह ऐसे कारावास से, जिसकी अवधि पांच वर्ष से कम की नहीं होगी, दंडित किया जाएगा और जुर्माने का भी दायी होगा तथा दूसरी या पश्चातवर्ती दोषसिद्धि की दशा में, ऐसे कारावास से, जिसकी अवधि सात वर्ष से कम की नहीं होगी, दंडित किया जाएगा और जुर्माने का भी दायी होगा।
(2) जो कोई उपधारा (1) के अधीन अश्लील प्रयोजनों के लिए किसी बालक या बालकों का उपयोग करके, ऐसे अश्लील कृत्यों में प्रत्यक्ष रूप से भाग लेकर, धारा 3 या धारा 5 या धारा 7 या धारा 9 में निर्दिष्ट कोई अपराध करेगा, वह उक्त अपराधों के लिए उपधारा (1) में उपबंधित दंड के अतिरिक्त क्रमशः धारा 4, धारा 6, धारा 8 और धारा 10 के अधीन भी दंडित किया जाएगा ।

2. After 2019 amendment - अगर वह व्यक्ति धारा 13 का अपराध करता है, धारा 3 ,5,7,9 के आशय से तो उस व्यक्ति को धारा 4,6,8,10 के साथ धारा 14(1) का भी दंड मिलेगा |
