Chapter 1 - Preliminary/प्रारंभिक (S1 and S2)

S2- Definitions/परिभाषाएं :- Total 14 definition.
(1)In this Act, unless the context otherwise requires,-
(1) इस अधिनियम में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-
(a) aggravated penetrative sexual assault" has the same meaning as assigned to it in Section 5;
(क) "गुरुतर प्रवेशन लैंगिक हमला" का वही अर्थ है जो धारा 5 में है;
(b) "aggravated sexual assault" has the same meaning as assigned to it in Section 9;
(ख) "गुरुतर लैंगिक हमला" का वही अर्थ है जो धारा 9 में है;
(c) "armed forces or security forces" means armed forces of the Union or security forces or police forces, as specified in the Schedule;
(ग) “सशस्त्र बल या सुरक्षा बल” से संघ के सशस्त्र बल या अनुसूची में यथाविनिर्दिष्ट सुरक्षा बल या पुलिस बल अभिप्रेत है;
(d) "child" means any person below the age of eighteen years;
(घ) "बालक" से ऐसा कोई व्यक्ति अभिप्रेत है जिसकी आयु अठारह वर्ष से कम है;
[(da) "child pornography" means any visual depiction of sexually explicit conduct involving a child which include photograph, video, digital or computer generated image indistinguishable from an actual child, and image created, adapted, or modified, but appear to depict a child;]
[(घक) "बालक संबंधी अश्लील साहित्य" से किसी बालक को सम्मिलित करते हुए लैंगिक संबंध बनाने के आचरण का कोई भी दृश्य चित्रण अभिप्रेत है, जिसके अंतर्गत फोटो, वीडियो, डिजिटल या कम्प्यूटर जनित ऐसी आकृति, जो वास्तविक बालक होने जैसी लगे और सृजित, रूपांतरित या परिवर्तित किन्तु बालक का चित्र प्रतीत होने वाली आकृति भी है;]
(e) "domestic relationship" shall have the same meaning as assigned to it in clause (f) of Section 2 of the Protection of Women from Domestic Violence Act, 2005 (43 of 2005);
(ङ) "घरेलू संबंध" का वह अर्थ होगा जो घरेलू हिंसा से महिला संरक्षण अधिनियम, 2005 (2005 का 43) की धारा 2 के खण्ड (च) में है;
(f) "penetrative sexual assault" has the same meaning as assigned to it in Section 3;
(च) "प्रवेशन लैंगिक हमला" का वही अर्थ है जो धारा 3 में है;
(g) "prescribed" means prescribed by rules made under this Act;
(छ) "विहित" से इस अधिनियम के अधीन बनाए गए नियमों द्वारा विहित अभिप्रेत है;
(h) "religious institution" shall have the same meaning as assigned to it in the Religious Institutions (Prevention of Misuse) Act, 1988 (41 of 1988);
(ज) "धार्मिक संस्था" का वह अर्थ होगा जो धार्मिक संस्था (दुरुपयोग निवारण) अधिनियम, 1988 (1988 का 41) में है;
(i) "sexual assault" has the same meaning as assigned to it in Section 7;
(झ) "लैंगिक हमला" का वही अर्थ है जो धारा 7 में है;
(j) "sexual harassment" has the same meaning as assigned to it in Section 11;
(ञ) "लैंगिक उत्पीड़न" का वही अर्थ है जो धारा 11 में है;
(k) "shared household" means a household where the person charged with the offence lives or has lived at any time in a domestic relationship with the child;
(ट) "साझी गृहस्थी" से ऐसी गृहस्थी अभिप्रेत है जहां अपराध से आरोपित व्यक्ति, बालक के साथ घरेलू नातेदारी में रहता है या किसी समय पर रह चुका है;
(l) "Special Court" means a court designated as such under Section 28;
(ठ) "विशेष न्यायालय" से धारा 28 के अधीन उस रूप में अभिहित कोई न्यायालय अभिप्रेत है;
(m) "Special Public Prosecutor" means a Public Prosecutor appointed under Section 32;
(ड) "विशेष लोक अभियोजक" से धारा 32 के अधीन नियुक्त कोई अभियोजक अभिप्रेत है ।
(2) The words and expressions used herein and not defined but defined in the Indian Penal Code (45 of 1860), the Code of Criminal Procedure, 1973 (2 of 1974), 2[the Juvenile Justice (Care and Protection of Children) Act, 2015 (2 of 2016)] and the Information Technology Act, 2000 (21 of 2000) shall have the meanings respectively assigned to them in the said Codes or the Acts.
(2) उन शब्दों और पदों के, जो इसमें प्रयुक्त हैं, और परिभाषित नहीं है किन्तु भारतीय दण्ड संहिता (1860 का 45), दंड प्रक्रिया संहिता, 1973 (1974 का 2), 2 [ किशोर न्याय (बालकों की देखरेख और संरक्षण) अधिनियम, 2015 (2016 का 2)] और सूचना प्रौद्योगिकी अधिनियम, 2000 (2000 का 21) में परिभाषित हैं, वही अर्थ होंगे जो उक्त संहिताओं या अधिनियमों में है ।

S2- (da)- child pornography -किसी भी सेक्सुअल एक्टिविटी में एक बच्चे को सम्मिलित करना , किसी भी तरीके से जिसके अंतर्गत आता है फोटो , वीडियो , डिजिटल या कंप्यूटर से बनाया गया एक ऐसा आकृति जो बिल्कुल वास्तविक बालक होना जैसा लग रहा है , और ऐसे चित्र को create , adopt, modified, किया जाता है जिससे यह लगे कि उस चित्र में एक वास्तविक बालक है |
S2(e)- Domestic relationship -
Under S2 (f) dv act 2005, दो व्यक्ति जब एक ही घर में किसी भी रिलेशन की वजह से एक दूसरे के टच में हो और साथ ही रह रहे हो या रह चुके हो ऐसा संबंध consanguinity, marriage, adoption और जॉइंट फैमिली में किसी भी तरीके का रिश्ता हो सकता है जो सीधे तरीके से एक बच्चे के टच में आता है और उसे किसी न किसी तरीके से रिलेशन मैं आता है |
S2(k) shared household - यह भी बिल्कुल डोमेस्टिक रिलेशनशिप की तरह ही है, सीधे तरीके से कहा जाए तो एक एक्यूज्ड- विक्टिम के साथ ही उस घर पर रह रहा हो या रह चुका हूं या बच्चे के किसी भी रिलेशन में टच में हो |
2. कोई भी ऐसा शब्द जो यहां पर एक्सप्रेस या डिफाइन नहीं किया गया है , तो उसका अर्थ समझ जाएगा जो डिफाइन होगा -
1.भारतीय दण्ड संहिता ,1860
2. दंड प्रक्रिया संहिता, 1973
3. [ किशोर न्याय (बालकों की देखरेख और संरक्षण) अधिनियम, 2015
4. और सूचना प्रौद्योगिकी अधिनियम, 2000. के अंतर्गत होगा |
